(1) The Platform provides audiobooks for download and streaming.
(2) The customer acquires the non-exclusive, non-transferable right to use the content for personal use. Distribution to third parties, public performance or commercial use is prohibited.
(1) The contract is concluded upon completion of the payment process.
(2) The Platform ensures high availability, but is not liable for temporary failures (e.g. maintenance work).
(1) Consumers generally have a statutory right of withdrawal.
(2) Expiry of the right of withdrawal: The right of withdrawal expires for contracts for digital content that is not supplied on a physical data carrier if the customer has expressly agreed that the execution of the contract shall begin before the expiry of the withdrawal period and has confirmed their knowledge that they expressly lose their right of withdrawal once the contract begins.
The customer undertakes to keep access data secret and not to misuse the Platform.
The Platform is liable without limitation for intent and gross negligence. In cases of slight negligence, the Platform is only liable for breach of essential contractual obligations, limited to foreseeable damage.
The Platform collects anonymized statistics on usage behavior and stores listening progress to ensure the functionality of the library.
(1) The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.
(2) If the customer is a consumer, mandatory protective provisions of the state in which the customer has their habitual residence remain unaffected.
(3) The place of jurisdiction is Osnabrück if the customer is a merchant.
(4) Should individual provisions be invalid, the contract remains valid in other respects.
